Next Week!

The California Commercial Real Estate Summit is next Tuesday and Wednesday and is now SOLD OUT!

CCRES is the one time of year that industry leaders from all sectors of the commercial, industrial, and retail real estate industry join come together from across the nation and hear from top policymakers and California State Legislators.

Prior to the event and meeting with Legislators, we will be offering one more Zoom Legislative Briefings on August 8 at 12pm. We hope these prior meetings will allow you more time to familiarize yourself with legislation and spend more time in Sacramento discussing with members!

We will be kicking off the event with a reception on August 9. The reception will be held at Prelude Kitchen and Bar, right across the street from the Capitol, starting at 5:30pm. This will be a great opportunity to network with other commercial real estate professionals and Legislators that swing by!

Bills Come in and They Don't Come Out -

Suspense

Next week marks one of the most significant milestones in the legislative session – Appropriations Suspense File. The Suspense File is where any bill that has a cost to the state’s General Fund of one-hundred-and-fifty-thousand ($150K+) or more goes so that the collective impact on the state budget can be examined. 

In recent years Suspense, as it is known, has become the first significant filter for legislative measures. Majority party bills are rarely held in the first policy committee as “courtesy” votes have become the norm, even for the most ill-conceived measures. However, Second House Suspense, where we are now, is where many bills will be stopped for the year.

Very real fiscal constraints hold many bills in Appropriations. Suspense is also a place where bills can quietly go away for political reasons as it is easier to say “we can’t afford your great idea,” and is sometimes a preferred alternative to collegial legislators than voting against the bill in policy committee. 

Several bills of interest to CBPA members are awaiting their fate on Suspense right now and will be discussed as CCRES, read below.

Potential Suspense

AB 1738 (Boerner Horvath) – EV Chargers

Mandates fully functioning EV charging stations be installed in existing commercial buildings, apartments, hotels and motels. Goes far beyond the EV standards adopted in December 2021.

AB 2260 (Rodriguez) – Property Management

Required certain building managers/property owners, including State-owned/leased buildings, to purchase, install, and provide training material on how to use a tourniquet meant for tactical combat casualty care.

AB 2206 (Lee) – Property Management

Required the lessor of a nonresidential building located within a nonattainment area to itemize parking costs in all lease agreements if the tenants of the building are provided free parking.

SB 260 (Wiener) – Taxes & Regulations

SB 206 requires the California Air Resources Board (CARB) to adopt regulations requiring the reporting of greenhouse gas emission data throughout the entire supply chain to include activities such as business travel, employee commutes, procurement, waste, and water usage.

SB 1105 (Hueso) – Taxes & Regulations {Specific to San Diego Delegation}

Establishes the San Diego Regional Equitable and Environmentally Friendly Housing Agency without meaningful engagement from stakeholders, including the affordable housing sector in San Diego County. SB 1105 would empower this duplicative agency, governed by an unelected board, to implement a broad range of taxes and fees to facilitate increased funding for major policies such as regional tenant protection and affordable housing development.

SB 1482 (Allen) – EV Chargers

Required the California Building Standards Commission (CBSC) to adopt mandatory building standards to provide each commercial building and multifamily dwelling unit with parking an electric vehicle charging station or receptacle.

SB 1410 (Caballero) – Goods Movement

Modifies the Vehicle Miles Travelled (VMT) regulation to be applied only in Urbanized Transit Priority Areas to help the state meet its ambitious climate goals while not penalizing much needed new housing and job centers.
